CHANDIGARH FAO No.37 of 2016 Date of decision: 28.08.2019 Nirmala Devi and another .......Appellants versus Mahtab Singh and others ......Respondents CORAM: HON'BLE MR. JUSTICE RAMENDRA JAIN Present: - Mr. Saurabh Kapoor, Advocate, for Mr. Ashit Malik, Advocate, for the appellants. Ms. Vandana Malhotra, Advocate, for respondent No.3. RAMENDRA JAIN, J. (ORAL) Through instant appeal, appellants-claimant have sought enhancement of compensation granted to them by the Motor Accident Claims Tribunal, Kurukshetra, vide Award dated 05.10.2015. Learned counsel for respondent No.3 - Insurance Company submits that the Tribunal has already awarded compensation in excess to the appellants against the dictum of the Hon'ble Supreme Court in National Insurance Company Limited v. Pranay Sethi and others, 2017(4) R.C.R. (Civil) 1009. Therefore, this appeal is liable to be dismissed. Learned counsel for the appellants has not been able to refute above submissions. Hence, instant appeal being meritless is dismissed as there is no scope of enhancement of compensation modifying the impugned award.
