(ORAL) Learned counsel for the petitioner argues that the petitioner suffered injuries on 30.09.2021 at the hands of private respondents and though, the petitioner has made a complaint/representation dated 01.10.2021 (Annexure P-3) qua the said incident, but no action has been taken so far on the said complaint by the police. Learned counsel for the petitioner submits that the petitioner will be satisfied, at this stage, in case a time bound direction is issued to respondent No.5 to decide the said complaint/representation dated 01.10.2021 (Annexure P-3) by passing an appropriate speaking order. Notice of motion.

CRM-M-47151-2021 -2Mr. Sandeep Singh Deol, Deputy Advocate General, Punjab, who is present in Court, keeping in view the service of advance copy of petition accepts notice on behalf of respondents No.1 to 5-State. Learned State counsel submits that an appropriate order on the complaint/representation dated 01.10.2021 (Annexure P-3) filed by the petitioner has already been passed by the authority concerned after ascertaining the facts from the concerned hospital and as per the facts, no allegation was substantiated, hence, no action is required to be undertaken any further.

Faced with this situation, learned counsel for the petitioner submits that he does not want to press this petition any further and the petitioner may kindly be allowed to withdraw this petition with liberty to avail appropriate remedy against the order passed by the police authorities on the complaint/representation dated 01.10.2021 (Annexure P-3) filed by the petitioner before the appropriate forum.
