Prayer in this petition, filed under Section 438 of the Code of Criminal Procedure, 1973, is for grant of anticipatory bail to the petitioner, who has been booked for having committed the offences punishable under Sections 3/13(1) and 8/13(3) of the Haryana Gauvansh Sanrakshan and Gausamvardhan Act, 2015, in a case arising out of FIR No. 371, dated 06.09.2022, registered at Police Station Sadar, Tauru, District Nuh.

It has already been admitted by the petitioner in para No. 6 of the petition that he is an accused in six other cases, details of which are also mentioned therein. Petitioner has also fairly mentioned that an FIR No. 3, dated 12.02.2012, under Section 174-A IPC, was also registered against him at Police Station Sadar, Tauru, District Nuh. Factum of identity, whether name of petitioner is PRASHANT KAPOOR 2022.09.19 16:39 I attest to the accuracy and authenticity of this order/judgment

CRM-M-42951-2022 "Sahabuddin" or "Habbu", is also clear from the fact highlighted by learned Public Prosecutor before learned Court below, which is mentioned in para No. 5 of the order dated 09.09.2022 (Annexure P-2), passed by learned Sessions Judge, Nuh, wherein it is mentioned - "......in other 6 cases registered against the petitioner, his name appears as Sahabuddin @ Habbu. His father's name and village name have also been correctly mentioned."

In view of the aforementioned factual position, benefit of anticipatory bail cannot be extended to the accused - petitioner. Present petition is dismissed.
