***** JASPAL SINGH, J Through instant petition preferred under Article 226/227 of the Constitution of India, petitioners have sought issuance of a writ of mandamus, directing the respondents to grant the benefit of leave encashment as is granted to their counterparts working in the government schools, in view of judgments passed by this Court in the cases of similarly situated employees vide (Annexures P-10 and P-11) as well as instructions issued by government from time to time, along with interest @ 9% per annum. 2.

At the very outset, learned counsel for the petitioners submits that petitioners feel satisfied in case direction is issued to respondents to decide legal notice(s) dated 08.09.2017 (Annexure P-12) in terms of judgment (annexure P-11) as well as instructions issued by government from time to time, within a stipulated period.

Without expressing any opinion on the merits of the case, the instant petition is disposed of with the direction to respondents to look into the grievances unfolded by the petitioners in legal notice(s) dated 08.09.2017 (Annexure P-12) and to decide the same in terms of instructions issued by government from time to time and particularly keeping in view the judgment passed by this Court in CWP-2407-2017 (O&M), captioned as "Kasturi Lal Saini & others v. State of Punjab and others", decided on 08.08.2017 (Annexure P-11), within a period of 3 months from the date of receipt of certified copy of this order.

In case, the petitioners still feel aggrieved against any of the order(s) passed by the concerned authority, they shall be at liberty to have recourse to the other remedies available under law including filing of writ petition.
