MANJARI NEHRU KAUL, J. (Oral) The instant petition has been filed under Section 439 Cr.P.C. for grant of regular bail to the petitioner in case FIR No. 118 dated 11.09.2020 under Sections 22-C/25 of NDPS Act, 1985 registered at Police Station Sadar Moga, District Moga.

In compliance of order dated 04.01.2021, status report with regard to the medical condition of the petitioner filed by learned State counsel through e-mail is taken on record subject to just exceptions. Office to tag the same at appropriate place.

As per the affidavit of Deputy Superintendent (M), Central Jail, Faridkot, filed along with the report of the Medical Officer, Jail Hospital Faridkot, the petitioner is indeed suffering from diabetes mellitus type-1 RUPINDER KAUR 2021.01.29 15:00 I attest to the accuracy and integrity of this document with hypertension with diabetic retinopathy with UGI bleed (? Erosive of

CRM-M-43062-2020 [ 2 ] PUD) and HCV+ and is being managed conservatively by the doctor. It has also been submitted in the said affidavit that the condition of the petitioner is stable as on date.

The learned counsel for the petitioner has apprised this court that as per his instructions the petitioner has been referred to PGI, Chandigarh, in the wake of his failing health. He therefore submits that the petitioner be granted the concession of bail so that he can be taken care of by his family and get treated either from PGI, Chandigarh, or some private hospital.

Heard.

This court is not inclined to extend the concession of regular bail as prayed for in the light of heavy recovery of contraband effected from the petitioner.

The petition is dismissed. However, taking into account the medical condition of the petitioner, the jail authorities shall ensure that the health condition of the petitioner is regularly and continuously monitored by the Jail doctors and as and when he is called by the doctors at PGI, Chandigarh for follow up check up, the jail authorities shall take him to PGI, Chandigarh without any delay.
