The petitioner through instant petition under Articles 226/227 of Constitution of India is seeking directions to respondent No.2 to re-issue passport.

Learned counsel for the petitioner inter alia contends that the petitioner was issued passport on 24.03.2005 which expired on 23.03.2015. An FIR dated 31.03.2010 under Section 120-B of IPC read with Section 7, 13 (1) (d) of Prevention of Corruption Act, 1988 came to be registered against the petitioner. The petitioner was convicted vide order dated 30.01.2017 and he was awarded sentence of 02 years. The petitioner preferred CRA-S-871-SB-2017 before this Court which vide order dated 06.03.2017 extended the suspension of sentence. The respondent has rejected application of the petitioner seeking renewal of passport on the ground that the court case is pending against him. Mr. Amit Sharma, Advocate, who on advance notice is present in Court, asserts that the passport authority in terms of aforesaid judgment of this Court would decide application of the petitioner within 06 weeks from the date of fresh application, if any, filed by the petitioner. 4.

In the wake of statement of learned counsel for the respondent, the petition stands disposed of. The petitioner is at liberty to move fresh application seeking renewal of passport as earlier application stands disposed of.
