Both the parties have settled their dispute before the Mediation and Conciliation centre. Therefore, in the interest of justice, the application is allowed condoning the delay of 41 days in preferring the appeal. FAO No. 3819 of 2016 Appellant Mohit Jain filed a petition before the trial Court under Sections 7, 9 and 25 of the Guardian and Wards Act, 1890 seeking custody of his minor son Hridaann. As the said petition filed by the appellant was dismissed by the trial Court, he has preferred the present appeal.

FAO No. 3819 of 2016 (O&M) the parties was sent before the Mediation and Conciliation Centre to settle the matrimonial dispute between the parties.

Now it is reported that the matter was amicably settled between the parties before the Mediation and Conciliation Centre. In view thereof, counsel appearing for the appellant seeks permission to withdraw the appeal in terms of the compromise entered into between the parties before Mediation and Conciliation Centre. Permission is granted. The appeal stands dismissed as withdrawn.
