Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.51 dated 11.06.2019 under Sections 323, 324, 341, 148 and 149 IPC (Section 326 IPC added later on), registered at Police Station Dera Baba Nanak, Police District Batala, District Gurdaspur.

I have heard learned counsel for the petitioner and have gone through the record as well as the report of the Registry. As per report of the Registry, first petition i.e. CRM No.33652 of 2019 was filed earlier for the same relief, which was dismissed vide order dated 21.08.2019 and this is second petition filed by the petitioner. The perusal of the record shows that the petitioner has concealed this fact and in the headnote, this petition has been mentioned as first petition and even in VINEET GULATI 2019.09.10 16:14 I attest to the accuracy and authenticity of this document Chandigarh the petition, it is nowhere mentioned that this is second petition. There is no

CRM No.M-36829 of 2019 -2mention regarding dismissal of the first petition, which means that the petitioner has tried to conceal the material facts and mislead the Court. The conduct of the petitioner is of such nature that he is not entitled to benefit of anticipatory bail.

As the petitioner has tried to conceal the material facts and to mislead the Court, therefore, this petition is dismissed with the costs of `10,000/- to be deposited with High Court Legal Services Committee within one month from today, failing which, Registry of this Court shall get it recovered as arrears of land revenue.
