Rajan Gupta, J (Oral) Learned counsel for the parties submit that out of court settlement has been arrived at between the claimant and the Insurance company. Learned counsel for the Insurance company submits that he is handing over a draft of Rs.75,000/- as full and final settlement in favour of the appellant. Draft is taken on record as mark 'A'. In view of above, learned counsel for the applicant submits that he may be allowed to withdraw this appeal.
