IN THE HIGH COURT OF PUNJAB AND HARYANA
AT CHANDIGARH CRM-26633-2019 in/and CRR-2176-2019 Date of Decision:-3.9.2019 SIRAJU DIN ... Petitioner
Versus
AAMNA HABIB ... Respondent *****
CORAM:
HON'BLE MR. JUSTICE GURVINDER SINGH GILL ***** Present:- Mr. Kulbhushan Raheja, Advocate for the petitioner.
***** GURVINDER SINGH GILL, J. (Oral)
1. There is delay of 184 days in filing the revision petition, wherein the petitioner has challenged order dated 26.11.2018. 2.
The ground set forth for condoning delay of 184 days is that the petitioner had handed over the entire brief and the documents to the Clerk of the counsel who was representing him before the Lower Court for the purpose of filing a petition by engaging Advocate in High Court and had also paid some necessary expenses but the said Clerk did not get the petition filed. 3.
Learned counsel for the petitioner has submitted that it was subsequently when he made inquires about his petition that he came to know that petition GAURAV SOROT 2019.09.03 17:55 I attest to the accuracy and integrity of this document
CRM-26633-2019 in/and CRR-2176-2019 had not been filed and by the time the petitioner engaged a counsel, the petition had become barred by limitation by 184 days. 4.
Having heard learned counsel for the petitioner, this Court does not find that aforesaid reason furnished by the petitioner is sufficient enough to condone the delay of 184 days. The application, as such, is sans merit and is hereby dismissed.
5.
The revision petition is consequently dismissed being time barred. ( GURVINDER SINGH GILL) 3.9.2019 JUDGE Gaurav Sorot Whether reasoned / speaking?
