(ORAL) CM-16180-CII-2024 This is an application filed under Order 22 Rule 4 read with Section 151 CPC for bringing on record the legal heir of respondent No.1 For the reasons stated in the application which is supported by an affidavit, the present application is allowed and legal representative of respondent No.1-Vipul Nagpal is ordered to be impleaded as party subject to

just exceptions and solely for the purpose of pursuing the main appeal and the same would not be construed as an adjudication on the entitlement of the estate of respondent No.1.

Amended memo of parties is taken on record.

CM-68-CII-2020 in FAO-68-2020 Present application has been filed under Section 5 of the Limitation Act for condonation of delay of 740 days in filing the present appeal.

For the reasons mentioned in the application, which is duly supported by an affidavit, present application is allowed and the delay of 740 days in filing the present appeal is hereby condoned. CM-70-CII-2020 in FAO-68-2020 This is an application filed under Order 1 Rule 10 read with Section 151 CPC to implead Sahibzada Ajit Singh Academy, Rupnagar, as respondent.

Learned counsel for the appellant submits that he does not press the present application.

CM-5174-CII-2020 in FAO-1704-2020 Present application has been filed under Section 5 of the Limitation Act for condonation of delay of 798 days in filing the present appeal.

For the reasons mentioned in the application, which is duly supported by an affidavit, present application is allowed and the delay of 798

days in filing the present appeal is hereby condoned. Main cases 1.

The present order would dispose of two appeals. The first is FAO-68-2020 which has been filed by Sukhandeep Singh, who is the driver of the offending vehicle. The second appeal is FAO-1704-2020 which has been filed by claimant-Vipul Nagpal. In the present cases, admittedly the vehicle in question was not insured.

Learned counsel for the appellants as well as respondents in both the cases have pointed out that during the pendency of the present appeals, the matter has been compromised vide compromise deed dated 27.11.2025, a copy of which has been handed over to the Court which is taken on record as Mark 'A'. It is submitted that as per the compromise, a total amount of compensation which was agreed to be paid by the driver as well as the owner of the vehicle in question was 15 lakh and the said ₹ amount has already been paid in the execution proceedings. It has been jointly submitted that in view of the said compromise, the present appeals have rendered infructuous and be disposed of as such. 3.

In view of the above, the present appeals are disposed of as having been rendered infructuous.
