The petitioner is in custody since 04.10.2023 and is seeking regular bail under Section 483 BNSS, 2023 (section 439 Cr.P.C.) with regard to offences punishable under Sections 376(2)(j)(l) of IPC along with section 506 IPC. 2.
The allegations are of committing rape on a woman incapable of giving consent and suffering from mental disability. 3.
It is also informed by learned counsel for the prosecution that seven out of nineteen enlisted prosecution witnesses have been examined and twelve still remain to be examined.

In an offence of this nature, where a woman of mental disability has been subjected to rape by the petitioner, it would be appropriate that safe and secure atmosphere is ensured to all the remaining prosecution witnesses to depose, and therefore for the time being, no case for grant of bail is made out. 5.
Petition stands dismissed.
