-.- KARAMJIT SINGH , J. (Oral) Prayer is for grant of anticipatory bail in case having FIR No.50 dated 18.3.2022 registered under Sections 148, 149, 323, 506 IPC (Sections 341, 307, 120-B IPC added later on ) at Police Station Rajaund District Kaithal.

The counsel for the petitioner inter alia contends that the petitioner was not named in the FIR and nominated as accused on the basis of disclosure made by co-accused Amrik and Ajay and the veracity of the same would be tested during trial. ( 2 ) CRM-M-42964-2022 submits that no specific injury has been attributed to the petitioner, who has joined investigation with the police.

State counsel on instructions from SI Ishwar Singh has not refuted the aforesaid assertions made by counsel for the petitioner and submits that petitioner has joined investigation with the police and is not required by police for further investigation or for custodial interrogation. In view of the above, without commenting on the merits of the case, the present petition is hereby allowed and order dated 19.9.2022 is hereby made absolute. The petitioner should abide by the conditions envisaged under Section 438(2) Cr.P.C.
