**** RAJ MOHAN SINGH, J.(Oral) Learned counsel for the petitioner submits that petitioner has been convicted and released on probation on his furnishing personal probation bonds in the sum of Rs.50,000/- for a period of one year with an undertaking to appear and receive sentence as and when called upon during such period and also to keep peace and good behaviour in the meanwhile. Passport can be refused under Section 6(2)(e) of the Passport Act, 1967 if the petitioner has, at any time during the period of five years immediately preceding the date of his MOHMED ATIK 2022.04.04 17:04 I attest to the accuracy and integrity of this document

CWP-22101-2020  application, been convicted by a court in India for any offence involving moral turpitude and sentenced in respect thereof to imprisonment for not less than two years.

Passport has been declined to the petitioner on previous two occasions on the basis of police verification. In view of aforesaid status of the petitioner, petitioner shall file fresh application before respondent No.2. Respondent No.3 shall also make necessary police report in accordance with law on the basis of interpretation attached to the misconduct of the petitioner in terms of Section 6 of the Passport Act, 1967. This writ petition is disposed of as such, by giving liberty to the petitioner to apply afresh. In the event of doing so, the respondent shall proceed to decide the application strictly in accordance with law and precedents on the issue.
