This petition is filed under Articles 226 and 227 of the Constitution of India, requesting the issuance of a writ of habeas corpus. The petitioner seeks a direction to the official respondents to produce her husband-Arjan Khan, who has been illegally detained, abducted, or missing since 03.07.2025. It is stated that he has neither been arrested nor produced before any Court. The petitioner also requests an independent inquiry into his disappearance and appropriate measures to protect the life and liberty of the petitioner's family.

In compliance of order dated 04.09.2025, learned State counsel has filed status report/reply by way of affidavit of Gurdeep Singh, PPS, Deputy Superintendent of Police, Sub-Division Amloh, District Fatehgarh Sahib on behalf of respondent-State in Court today, which is taken on record and according to which, Arjan Khan, the petitioner's MOHIT 2025.09.25 17:54 I attest to the accuracy and integrity of this document

CRWP-7309-2025(O&M) -2husband, is not in illegal custody of the police, as claimed in the petition, rather is wanted in FIR No. 118 dated 06.07.2025 and has been intentionally avoiding arrest.

Learned State counsel submits that the investigation records clearly show that the alleged detenue has not been detained or abducted by the police, instead, he is hiding to avoid legal action. 3.

Be that as it may, the petitioner has approached this Court by filing the present petition, seeking issuance of a writ in the nature of habeas corpus for the release of her husband, Arjan Khan, from alleged illegal custody. In view of the facts and submissions on record and status report, no further directions are considered necessary in this matter. 4.

Accordingly, the petition stands disposed of with the above observations.
