(ORAL) Present writ petition has been filed by the petitioner with a prayer that he has filed a mercy appeal (Annexure P-14) before the respondent claiming that he be awarded his B.E/B. Tech Degree by rounding off the marks secured by him i.e. 39.76% to 40%, keeping in view the law laid down by the Division Bench of the Himachal Pradesh High Court, which judgment has already been upheld by the Hon'ble Supreme Court of India (Annexures P-12 and P-13 respectively). Learned counsel for the petitioner submits that the mercy appeal dated 03.11.2020 (Annexure P-14) is still pending consideration with the respondent authorities and he will be satisfied, at this stage, in case a time bound direction is issued to the respondents to decide the said mercy appeal by passing an appropriate speaking order.
