The prayer in the petition is for quashing the show cause notice dated 12.02.2018, Annexure P-9 and for restraining the respondent from terminating the services of the petitioner from the post of Excise and Taxation Officer. 2.

Learned counsel submits that the petitioner has since retired on 31.01.2023, after attaining the age of superannuation, during the pendency of this case, however his retiral benefits have not been released only on account of the present lis. His case is otherwise squarely covered by the judgment passed by a Division Bench of this Court in Dr. Ravinder Singh vs. State of Punjab, 2012(2) SCT 92, copy of which has been handed over to learned State counsel. He submits, on instructions, that time bound direction be given to the respondents to consider his claim accordingly.

Learned State counsel has no objection to the limited prayer made. 4.

In view of the aforesaid and without commenting upon the merits of the case, this petition is hereby disposed of with a direction to the respondents to DINESH 2024.04.27 02:23 I attest to the accuracy and integrity of this document

CWP-4843-2018 (O&M) 2024:PHHC:055285 -2consider and decide the claims of the petitioner, by taking into account the aforesaid judgment, within a period of six months, which this Court has no reason to believe the authorities would not address in a just, fair and reasonable manner. Upon doing so, after notice and hearing offered to them, and if found entitled, grant the benefit forthwith. Needless to say, if the orders are adverse to their interest, the same shall contain reasons and the petitioners shall be free to seek legal redress.
