In the instant petition, the petitioner seeks a direction to official respondent Nos. 1 to 8 / State of Punjab, to complete the investigation in FIR No. 6 of 09.01.2020 (Annexure P-1), constituting therein offences under Sections 279 & 304-A of IPC, and, registered at P.S. Sadar Ahmedgarh, District Sangrur, and, to file a report under Section 173 Cr.P.C. against the accused, before the learned Magistrate concerned. 2.

Learned counsel for the petitioner has vehemently argued, that co-respondent No. 9 is the principal accused in the offences, as carried in the FIR (supra). He has also argued that the Investigating Officer (IO) concerned, is not naming co-respondent No. 9, as the principal accused in the FIR (supra) 3.

However, the afore made arguments before this Court, by the learned counsel for the petitioner, is completely negated, as the learned State Counsel, on instructions from SI Darshan Singh, IO, submits that after completion of the investigation (supra) in the FIR (supra), a report under Section 173 Cr.P.C. is under preparation, and, therein the respondent (supra) DINESH KUMAR 2021.11.15 15:26 I attest to the accuracy and integrity of this document

CRM-M No. 47588 of 2021 (O&M) -2would be named as principal offender. Moreover, since the learned State Counsel, on instructions meted to him by the IO, submits, that the latter shall within three weeks, finalize the report under Section 173 Cr.P.C., and, also submit it before the learned Magistrate concerned. 4.

Therefore, the learned counsel for the petitioner, does not press the present petition, as the relief (supra), as claimed in the petition, becomes at this stage, rather completely mitigated.

Consequently, the petition is disposed of with a direction, to official respondents (supra), to within three weeks hereafter, institute the report under Section 173 Cr.P.C. before the learned Magistrate concerned, detailing therein the name of co-respondent No. 9 (Rajvir Singh), as the principal accused vis-a-vis the offences constituted in the FIR (supra).
