* * * ANIL KSHETARPAL, J. (ORAL) In the present case the petitioner prays for release on the ground that final report was not submitted within the period specified in Section 167 (2) Cr.P.C.

It is not disputed that the petitioner did not furnish bail as directed by the Court, thereafter, after presentation of the final report, his right stands defeated in view of the judgment passed by the larger Bench in Uday Mohanlal Acharya Vs. State of Maharashtra, 2001 (2) RCR (Crl.), 452.

CRM-M-36849-2019 Learned counsel for the petitioner, in the alternative, has submitted that his bail application should be considered on merits. On the the other hand, learned counsel for the State has informed the Court that trial of the case has made substantial progress and prosecution has already closed its evidence.

In view of aforesaid facts, there is no reason to grant concession of bail at this stage.

The petition is dismissed.
