Prayer in the instant petition, inter alia, is for issuance of a direction to the respondents to release the payment of the petitioner for the contractual works executed by it in the year 2015. The grouse of the petitioner is that the admitted liability towards the outstanding payments for the works executed is not being paid despite due acknowledgment and admission thereof. Despite availing sufficient opportunities, reply has not been filed on behalf of the respondents.

Heard.

The petitioner has already executed the work to the satisfaction of the respondents as there is no rebuttal to this fact on behalf of the respondents. Therefore, the latter are under obligation to make the payment. In view of the above, the instant petition is allowed. The

CWP-4869-2018 (O&M) -2respondents are directed to release the contractual amounts to the petitioner within 45 days from today, failing which, the same shall carry interest at the rate of 7.5% per annum from the date of issuance of necessary certification of the work(s) executed.
