* * * * S.J. VAZIFDAR, C.J. (ORAL) The petitioner has challenged the respondents' decision to abandon the tender process to invite fresh bids. The petitioner also seeks an order directing the respondents to award the contract in its favour.

The respondents by an office order directed the cancellation of the tender process on the ground that the Executive Engineer had committed serious violations in respect of the tender process. It was also decided to invite the fresh bids. 3.

A bidder is not entitled as a matter of right to be awarded a contract merely because his bid is the lowest. Admittedly, a contract was not entered into between the parties. 4.

The petitioner is not prejudiced in any manner for it can participate in the fresh tender process.

The petition is accordingly dismissed.
