Petitioner while serving as Senior Executive Engineer Distribution, Sunder Nagar Urban Division, PSPCL Ludhiana was proceeded against in a departmental enquiry on the alleged charge of lack of supervision. The departmental enquiry culminated into passing of punishment order dated 9.12.2015 whereby major punishment of stoppage of two annual increments with future effect were imposed upon him. Aggrieved against the same, petitioner filed an appeal. The said appeal was dismissed by the Appellate Authority vide impugned order dated 7.12.2017. The grievance raised is that the Appellate Authority has not dealt with the submission/grounds raised by the petitioner in his appeal. Notice of motion was issued.

At the time of hearing today, it is agreed by the counsel for the parties that the instant writ petition is squarely covered by a decision dated 3.12.2018 rendered by a Co-ordinate Bench of this Court passed in CWP RAJINDER PARSHAD JOSHI 2018.12.20 15:29 I attest to the accuracy and integrity of this document

In view of the above, the instant writ petition is partly allowed and the order dated 7.12.2017 (P-13) passed by the Appellate Authority is set aside. The matter is remanded back for consideration afresh at the hands of the Appellate Authority for taking into account all the submissions and contentions raised by the petitioner in the appeal/supplementary statement/representation. Let the final order upon re-consideration be passed within a period of two months from today after affording to the petitioner an opportunity of personal hearing. Disposed of in the above terms.
