(ORAL) This petition has been filed by the petitioner being aggrieved by an order dated 11.10.2021(Annexure P-10) passed by the Assistant General Manager (WH), HAFED, Panchkula, whereby its representation dated 08.02.2021 that was required to be considered and decided by the respondent-authorities in terms of the statement and undertaking given by them in CWP-5396-2021 has been dismissed by simply stating that no material point was found therein. Learned counsel for the petitioner submits that it had raised several issues before the authorities regarding the technical viability of the private respondent No. 3 and had also filed reports of Halka Patwari, Naraingarh dated 15.02.

2021 (Annexures P-5 and P-6) as well as the comments of the District Manager, HAFED, Ambala dated 18.02.2021, according to which the respondent No. 3 was liable to be disqualified, but the authorities without considering the same have simply dismissed its complaint/representation stating that no material point was found therein.

When confronted with the aforesaid aspect, Mr. Deepak Balyan, learned Additional Advocate General, Haryana, appearing for respondents No. 1 and 2, on advance copy, submits that the respondent-authorities had thoroughly examined the matter and thereafter dismissed the representation. He, however, concedes the fact that the respondent-authorities have not mentioned the reasons in the order dated 11.10.2021 and, therefore, submits that they will pass a fresh detailed order within three days and communicate the same to the petitioner. In view of the aforesaid submission of learned counsel for the petitioner as well as the statement made by learned Additional Advocate General, Haryana, the writ petition stands disposed of.
