Petitioner was appointed on the post of Tax Collector on compassionate grounds as his father who was a Panchayat Secretary died in harness. Petitioner has served as such for 12 years. He has now preferred this petition on the plea that he is entitled to higher post as other similarly placed employees have been appointed as Social Education and Panchayat Officers. According to him, the State has discriminated while granting higher posts to the similarly placed persons. I find no merit in the plea. The appointment on compassionate ground is merely in the nature of concession. It cannot be lost sight of the fact that moment an appointment on compassionate ground is made, one post is taken out of the normal quota against which a candidate would be entitled to be appointed on merits. Besides, petitioner has willingly accepted the post and working as such for 12 years.
