JUSTICE RAJBIR SEHRAWAT Present:- Mr. Bhupinder Ghai, Advocate for the petitioners. **** Rajbir Sehrawat, J.(Oral) This petition is filed for quashing of impugned order dated 23.11.2020 (P-10) passed by respondent No.2 vide which the representation dated 27.08.2020 filed by petitioners was rejected by respondent No.2, while making wrong reference of law and facts and for issuance of any other appropriate order or direction which may deem fit and proper in the facts and circumstances of the case.

Ms. Deipa Singh, Addl. AG, Haryana accepts notice on behalf of State and Mr. Jagbir Singh, Advocate accepts notice on behalf of respondent No.3.

The counsel for the respondent No.3 has pointed out that earlier also the petitioners had filed CWP No.15936 of 2018 and the same was dismissed as not maintainable by this Court vide order dated 06.07.2018. The reason for dismissing the writ petition as not maintainable was that lot of disputed questions of facts were involved in the matter. The subject matter of the present writ petition is also the same as was of the earlier writ petition. CWP No.22286 of 2020 -2when the first petition has been held to be non-maintainable and that order had remained intact.

Accordingly, the present writ petition is dismissed. However, the petitioner would be at liberty to seek his remedy before the Civil Court, but in accordance of law.
