The petitioners claim that they have been running an outlet having been allotted franchise by Essar Oil Limited on a land in village Kablana, Tehsil and District Jhajjar.
The grievance of the petitioners is that the Indian Oil Corporation has permitted installation of retail outlet in the same village on Jhajjar- Bahadurgarh Road within a radius of 1000 meters, which is not permissible.
A direction has been sought, through the present writ petition, for enforcing the instructions dated 25.9.2003 (Annexure P-6) issued by the Union of India for installation of the fuel stations. I have heard counsel for the petitioners and I am of the opinion that the petitioners have not approached any authorities or the Indian Oil Corporation raising their objections to the installation of the proposed outlet. The writ petition is pre-mature and is not maintainable at this stage. The petitioners may approach the Indian Oil Corporation or any other authority, competent to look into the grievance of the petitioners. In case any such application is filed, it is expected that the same will be decided by the competent authority taking into consideration the instructions of the Union of India dated 25.9.2003.
