DEEPAK GUPTA , J.(Oral) Status report by way of affidavit of Shri Manoj Gorsi, Deputy Superintendent of Police, Sub Divison, Sangrur, along with custody certificate has been placed on record. Petitioner prays for grant of regular bail in case FIR No.163, dated 19.08.2022, under Sections 379-B, 212, 120-B, 411 of IPC (Sections 465, 467, 468, 471, 414 and 201 IPC added later on), registered at Police Station City Sangrur, District Sangrur. It is contended by learned counsel for the petitioner that similarly placed co-accused Malkit Singh and Dalip Singh have already been allowed bail by this Court vide order dated 18.01.2023 (Annexure P4) and 31.01.2023 (Annexure P-5) respectively. Learned counsel further contends that the only attribution as per the status report of the police is ₹ that an amount of 14,000/- was recovered from him.

Learned counsel contends that recovery is not connected with the crime. While granting bail to co-accused Malkit Singh and Dalip Singh, the facts were noticed to the effect that as per the secret information received, 7-8 persons formed a gang for committing SARITA RANI 2023.10.

CRM-M-41771-2023 - 2 - snatching of gold ornaments of ladies and old people and those gang members used to stay in the poultry form of the Malkit Singh. Name of neither any co-accused nor that of the petitioner was mentioned in the FIR.

As per custody certificate placed on record, petitioner is in custody for the last 11 months and 17 days, though, he is involved in other cases.

Having regard to the role of the petitioner in the present case and considering the fact that co-accused, who are similarly placed, have already been allowed bail by this Court, but without commenting anything on the merits of the case, petitioner is admitted to bail. He is ordered to be released on bail on his furnishing requisite bail bonds and surety bonds to the satisfaction of learned Trail Court/Duty Magistrate concerned.
