For the nature of order, I propose to pass in the matter, no formal written statements/counter affidavits on behalf of the respondents are indeed necessary, at this stage. Thus, with the consent of the parties, the petition is being disposed of finally.
The petitioner competed for selection to the post of Grid Substation Operator in the General Category, for, he was fully eligible therefor. He appeared in the written examination, but was never called for scrutiny of documents. However, the Commission subsequently published the result of the written examination. And, as per the self-assessment of the OMR sheet of the petitioner and the answer key uploaded by the Commission on its website, he had obtained 118 marks, whereas the candidate, who has obtained 110 marks in his category, has since been called for interview, Prashant Kapoor 2018.03.08 17:50 I attest to the accuracy and authenticity of this document
CWP-5233-2018 which is slated to take place on 10.03.2018. It is urged that it is for some intangible reasons, the claim of the petitioner has since been ignored. And, in the event the petitioner is not permitted to participate in the interview, he shall suffer an incalculable loss.
In response, learned State counsel submits that the claim/grievance of the petitioner shall be considered and dealt with by tomorrow, i.e. 09.03.2018, at best by 11.00am. And appropriate orders in accordance with law, shall be passed and communicated to the petitioner as also to his counsel.
The petition is accordingly disposed of in the above terms. However, in the event the claim of the petitioner is declined, the respondent authorities shall pass a comprehensive order assigning reasons in support thereof. On the contrary, if the petitioner is found to be eligible, and rather ought to have been called for interview, the necessary intimation, in time, shall be sent to the petitioner as also to his counsel, so as to enable the petitioner to participate in the interview process.
