The present petition has been filed by two petitioners, whose part of the land has been acquired for the purpose of construction of road by National Highways Authority of India (NHAI) and in this regard an award has already been passed by competent authority on 28.10.2022 (Annexure P-2). 2.

The grievance of the petitioners is that in guise of the said award, adjacent to the acquired land, belonging to the petitioners, which was never subjected of the acquisition, is being used for the purpose of construction of the road and the flour mill standing on the said land is threatened to be demolished by NHAI.

Learned counsel for NHAI, who appears on advance notice, assures that no other land except the one which has been acquired and in respect of which award has been passed, will be acquired. However, he informs that another acquisition proceedings are underway after issuance of RAVINDER KUMAR 2025.07.22 17:08 I attest to the accuracy and integrity of this document

 



  [2] the notification dated 11.12.2024 (Annexure P-6) under Section 3-D of the National Highways Act, 1956 for acquisition of other pieces of land including land belonging to petitioners and which is subject matter of this Civil Writ Petition, bearing Khasra No. 37/11/2, village Tangori, District SAS Nagar, Mohali, Punjab.

3.1 It is also informed by learned counsel for NHAI that for the land proposed to be acquired and also for clearing the construction of flour mill, the NHAI shall be granting adequate and lawful compensation. 4.

This Court has no manner of doubt that compensation due to the petitioners in accordance with law shall be paid for the land which is proposed to be acquired and also for demolition of the flour mill. 5.

In case the petitioners have any grievance with regard to their land being acquired by the NHAI, then petitioners are at liberty to avail remedy under the National Highways Act.

With the abovesaid observations and liberty, the petition stands disposed of.
