Vide order dated 29.1.2017 (Annexure P-1) respondent No.1 has rejected the application of the petitioner u/s 340 Cr.P.C. Aggrieved against the said order, the present writ petition has been filed. The writ petition is apparently not maintainable on account of alternative remedy available to the petitioner u/s 341 Cr.P.C., which provides that any person whose application has been refused , to make a complaint under sub- section 1 or sub-section 2 of Section 340 Cr.P.C. and the same can be challenged in appeal to the higher court. No ground is made out for entertaining the petition.

Dismissed by relegating the petitioner to the alternative remedy, if advised so.
