(Oral) Learned counsel for the petitioner submits that he does not press this petition but since the impugned order has been passed inter alia on the ground that the application under Order 39 Rule 1 and 2 has still not been decided, the trial Court may be directed to decide the same on the next date of hearing i.e. 18.11.2021.

Considering the nature of the order being passed issuance of notice of motion being dispensed with.

The petition is disposed of with a direction to the concerned trial Court to decide the application for ad interim injunction either on 18.11.2021 or on the next date of hearing.
