**** ANITA CHAUDHRY, J Limited notice had been given to the insurance company as the plea raised was that no amount had been allowed for love and affection for the mother.
Counsel for the insurance company has appeared. I have heard both the sides.
The Tribunal had taken the income tax return into account while assessing the income and had made 1/4th deduction and had added 30% as future prospects and had awarded adequate compensation on all the heads including loss of consortium, funeral expenses and for the care and guidance of the minor children. However, no amount was allowed for the mother. Therefore, I would add Rs. 50,000/- for love and affection for the mother i.e. appellant No. 4 and the award is modified. The amount be paid Gurpreet Singh Bhatia 2017.07.21 10:34 I attest to the accuracy and authenticity of this document Chandigarh within two months failing which the amount would be paid with interest @
F.A.O No. 4667 of 2016 -26% from the date of filing of the appeal.
The appeal is partly allowed.
