Prayer in the present transfer application, filed under Section 24 CPC, is for transfer of case No. HMA/280/2023, titled as "Rajdeep Singh v. Rupinder Kaur", under Section 9 of the Hindu Marriage Act, 1955, pending in the Court of Principal Judge, Family Court, Amritsar, to the Court of competent jurisdiction at Rupnagar.

Mr. V.K. Sandhir, Advocate, has put in appearance on behalf of the respondent and furnished his Vakalatnama, which is taken on record. Registry to tag the same at an appropriate place. At the very outset, Mr. V.K. Sandhir, learned counsel for the respondent, informs this Court that no transfer order can be passed in the present transfer application because petition under Section 9 of the Hindu Marriage Act, 1955, filed by the respondent-husband, and sought to be PRASHANT KAPOOR 2023.12.08 16:09 I attest to the accuracy and authenticity of this order/judgment

TA-1049-2023 - 2 - transferred, in fact, has already been dismissed in default, before filing of the present transfer application.

In view of the statement made by learned counsel for the respondent, present transfer application is disposed of, having been rendered infructuous.

However, liberty is granted to the applicant/petitioner to seek revival of the present petition, in case respondent succeeds in getting his petition under Section 9 of the Hindu Marriage Act, 1955, restored. Disposed of.
