(ORAL) The present petition has been filed under Section 482 Cr.P.C. for quashing of FIR No. RCCHG2018A0019 dated 05.10.2018 under Section 120-B IPC and Sections 7 & 8 of Prevention of Corruption Act, 1988 at Police Station CBI, ACB, Chandigarh. Learned counsel for the petitioner has drawn attention of this Court to paragraph 22 of the order dated 19.05.2022 and submits that the trial Court has prima facie given an opinion regarding framing of charges which is bias and prejudice. I have also gone through the same.
On this, learned State counsel submits that charges have already been framed.
At this stage, learned counsel for the petitioner submits that even the order of framing of charges is a formality because the Court had already formed an opinion even prior to hearing the accused in this regard.
Since, the charges had already been framed against the petitioner. Given above, the present petition is not maintainable and the same is disposed of. Liberty reserved to file a petition for challenging the framing of charges, the time for which the present petition is pending before this Court shall not be counted for the purpose of limitation.
