HARINDER SINGH SIDHU, J Prayer is for grant of regular bail in case FIR No.08 dated 09.02.2020 under Section 21 of NDPS Act registered at P.S Mukandpur, District SBS Nagar (Nawa Shahar).

As per allegations in the FIR, 300 grams of heroin was recovered from the conscious possession of the petitioner. Investigation in this case is complete. The challan has been filed. The petitioner is in custody for almost one year seven months. However, the trial of the case has not progressed because of covid-19 pandemic.

Without commenting anything on the merits of the case and also bearing in mind the custody period coupled with the fact that the trial of the case is not likely to be concluded in near future, no useful purpose will be served by detaining the petitioner behind bars any further. The petition, as such, is accepted. The petitioner Vipan Kumar @ Vipin Kumar is ordered to be released on bail on her furnishing bail bonds/surety bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/Duty Magistrate concerned.
