SANDEEP MOUDGIL, J (Oral) This petitioner has been filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of anticipatory bail to the petitoner in case FIR No.94 dated 10.07.2024 under Sections 420, 120-B, 34 IPC registered at Police Station, Sadar Samana, District Patiala. 2.

The parties have agreed to settle their grievance raised in the FIR No.328 dated 17.11.2024, registered at Patran, District Patiala, wherein Malkit Kaur, complainant has named Jaswinder Singh (complainant in present case) and Krishan Singh Ghai as two accused persons therein. In the said FIR, today during the course of hearing in the instant petition, this Court with the due assistance of learned counsel for the petitioner and complainant, facilitated efforts towards an amicable resolution of the dispute and it has been argued that settlement has been arrived at to the effect that complainant will return the car alongwith original registration certificate to the petitioner. It has been pointed out that petitioner Sukhjinder Singh is present in person before the Court. 3.

Mr. Sewak, Advocate appearing on behalf of complainant also undertakes before this Court that he will also pay a sum of ` 2.5 lakhs to the petitioner within a period of two weeks.

In view of the settlement arrived at between the parties, the dispute stands resolved in the entirety including the FIR No.328 dated 17.11.2024 registered at Police Station, Patran, District Patiala. Also the counsel for petitioner has pointed out that 138 of Negotiable Instruments Act, 1881 complaint was also got registered by the complainant and that too should be quashed. Hence, this Court finds no reason to continue the proceedings under Section 138 of the Negotiable Instruments Act, 1881, when the amount stands paid to the complainant.

It has also been agreed between the parties before this Court that quashing petition on the basis of the settlement arrived at in the aforesaid terms, can be filed if so advised, including the FIR No.328 dated 17.11.2024, registered at Patran, District Patiala.

In view of the above, complaint is quashed. Interim order dated 14.08.2024 is hereby made absolute. Further, it is clarified that demand draft of ` 10 lakhs which was handed over to complainant on the last date of hearing, shall now be released to Jaswinder Singh who can present it to the concerned bank for credit of the amount to his account. 7.

The petition stands disposed of accordingly.
