Seeking setting aside of order dated 11.08.2023 passed by respondent No.2 in terms of Government policy dated 04.02.1993 and policy dated 12.04.2002 and to consider premature release of petitioner in view of said policies, the petitioner has come up before this Court under Article 226 of Constitution of India. 2.

State has filed detailed reply dated 20.08.2024 whereby in paragraph 4 of the reply, reasons for rejection of premature release of the petitioner have been mentioned. 3.

On this, counsel for the petitioner seeks to withdraw the present petition with liberty to file fresh representation for pre-mature release before the competent authority with liberty reserved to the petitioner to come up again to this Court and prayed for direction to competent authority to decide his representation afresh without being influenced with the previous rejection.

Given above, the present petition is disposed of with liberty reserved to the petitioner to come up again to this Court, if need so arises. It is clarified that the competent authority shall take decision on the fresh representation, so filed by the petitioner, without being influenced by the previous rejection order(s) and shall take decision afresh within a period of 03 months after filing of such representation by the petitioner.
