(ORAL) The petitioner, through the instant petition under Section 482 Cr.P.C., is seeking direction to Superintendent of Police, Kurukshetra to further investigate the matter arising out of FIR No. 0066 dated 5.4.2022, registered at Police Station Dhand, District Kaithal, under Sections 323, 354-B, 498-A and 34 of IPC.(Annexure P-1).

Status report by way of affidavit dated 19.10.2022 of Ravinder Sangwan, Deputy Superintendent of Police, Kaithal filed on behalf of respondent No. 1 is taken on record. Registry is directed to tag the same at an appropriate place.

Pointing out to reply, learned State counsel submits that police after completion of challan has filed its report under Section 173 Cr.P.C. wherein husband and mother-in -law of the petitioner has PARAMJIT KAUR SAINI 2023.03.16 16:33 I attest to the accuracy and authenticity of this order/judgment

CRM-M-43989 of 2022 -2been nominated as accused. During the course of investigation, father-in-law and brother-in-law of the petitioner had been found innocent, thus, they are not named in the charge sheet. Police, during investigation, found that offence punishable under Section 354-B IPC has not been made out against the alleged accused. In view of statement of learned State counsel, it is an undisputed fact that trial court is seized of the matter. Husband and mother-in-law of the complainant are facing trial. The petitioner is at liberty to move an appropriate application at appropriate stage before the trial court, if he feels aggrieved from investigation of the investigating agency. No further order is warranted. Disposed of.
