On 14.08.2024, the following order was passed:- "Apprehending his arrest in FIR No.173 dated 6.8.2012, registered for offences punishable under Sections 323, 324, 354, 34 of IPC, at Police Station City Kapurthala, District Kapurthala; the petitioner has preferred this petition under Section 482 of BNSS, 2023, seeking pre-arrest bail.

Inter alia contends that the petitioner had noted a wrong date of hearing and on account of this, he was unable to appear before the Court below in time. According to learned counsel, the petitioner is willing to appear before the concerned Court on the next date of hearing.

Notice of motion.

At the asking of the Court, Mr. Adhiraj Singh Thind, AAG Punjab, accepts notice on behalf of respondent no.1/State of Punjab. It is directed that in case the petitioner appears before the concerned trial Court on or before 28.8.2024, he shall be admitted to interim bail by the said Court.

CRM-M-39635 of 2024 Learned counsel for the petitioner as also learned State counsel are ad-idem that the petitioner has entered appearance before the concerned trial Court on 28.08.2024 wherein he has been admitted to interim bail in terms of the interim order dated 14.08.2024 passed earlier by this Court. Keeping in view the entirety of facts and circumstance of the case, the interim order dated 14.08.2024 earlier passed by this Court is confirmed subject to the petitioner continuing to appear (in accordance with law) before the trial Court and face trial.

The petition stands allowed accordingly.
