(Oral) The instant writ petition has been filed seeking to challenge the provisions set out in advertisement dated 09.11.2015 (Annexure P-1) issued for filling up 3522 posts of ETT Teachers in which upper age limit of 37 years had been fixed ignoring the provisions of the Punjab State Education Class III (Primary School Cadre) Service Rules, 1997 in which the age limit had been prescribed to be 42 years.

This Court has already gone into the issue in CWP No. 315 of 2016 titled as Parminder Kaur and others vs. State of Punjab and others, decided on 03.04.2017, wherein, it has been held that the age specified in the advertisement is not sustainable and has to be in accordance with the Punjab State Education Class III (Primary School Cadre) Service Rules, 1997 notified on 11.06.1998, which is 18 to 42 years. The law point as raised in the instant writ petition in no longer res integra. Hence, the present writ petition is allowed in the same terms as in CWP No. 315 of 2016 (supra).
