This revision petition has been filed against the order dated 18.05.2023, passed by learned Additional District Judge, Rohtak, whereby petitioner and respondents no.3 to 5 have been restrained from causing interference in the peaceful possession of respondents no.1 and 2 till pendency of application under Order 39 Rules 1 and 2. 2.

After arguing for some time, learned counsel for the petitioner submits that the petitioner would be satisfied, if application under Order 39 Rules 1 and 2, pending before the learned Trial Court is ordered to be decided expeditiously and in such a situation, he would seek permission to withdraw the present revision petition.

Keeping in view the fact that the appeal was filed against the order whereby interim injunction was not granted, but in the appeal, the impugned order has been passed, where injunction is granted till the disposal MONIKA 2023.08.28 10:44 I attest to the accuracy and integrity of this document

2023:PHHC:111609 C.R.No.4856 of 2023 -2of application under Order 39 Rules 1 and 2 by learned Trial Court. Such application for temporary injunction is required to be disposed of expeditiously. So, learned Trial Court is directed to decide the application under Order 39 Rules 1 and 2 as early as possible, within one month positively.

In view of the aforesaid, the present revision petition is dismissed as withdrawn.

The petitioner is directed to appear before the learned Trial Court on 29.08.2023.
