JUSTICE AMIT RAWAL -.- AMIT RAWAL J.(ORAL) The petitioner is aggrieved of the order whereby the Wakf Board has withdrawn the execution petition against whom a suit had been filed on the premise that there is an apparent collusion whereas the petitioner is stated to have been taken land on lease in 2003 and had been paying the lease money till 2014.

In case, the petitioner, had not been put in possession, he has independent remedy to seek specific performance of the lease under Section 39 of the Specific Relief Act, much less, damages but not in the manner and mode by filing the writ petition seeking the Wakf Board to pursue with the execution application.

No ground for interference is made out. The writ petition stands dismissed.
