...Respondent(s)
CORAM: HON'BLE MS. JUSTICE RITU BAHRI, ACTING CHIEF JUSTICE HON'BLE MR. JUSTICE AMAN CHAUDHARY
Present:
Mr. Rohit Bansal, Senior Deputy Advocate General, Punjab, for the appellants.
Mr. Tushaar Madaan, Advocate, for the respondent.
* * * * RITU BAHRI, A.C.J. (ORAL) CM-1941-LPA-2022 For the reasons mentioned therein, the delay of 210 days in filing the appeal is condoned.
The application stands disposed of.
LPA-810-2022 The appellants have come up in appeal against the judgement and order dated 03.02.2020 passed by the learned Single Judge, whereby the writ petition being CWP-20246-2016 filed by the petitioner (respondent herein) had been allowed giving him the benefit of instructions dated 19.11.2014 (Annexure P-9) by which benefit of extension in the age of retirement from 58 years to 60 years was granted. The present appeal has been filed by the appellants only on the ground that the respondent had approached this Court when he attained the age of 62 years and had obtained all the retiral benefits which itself cannot be a ground to deny the benefit to him as the benefit had to be granted by the appellants at the initial stage by extending his services from 58 years to 60 years and this benefit has been denied without any cogent reasons.
In view of the aforesaid, we are of the considered opinion that the impugned judgement passed by the learned Single Judge does not require any interference as it has been passed on the basis of the judgement dated 31.10.2015 passed by a Coordinate Bench of this Court in CWP-23145-2015 titled as Paramjit Singh Vs The State of Punjab and others. The appeal being meritless, accordingly, stands dismissed.
