(ORAL) This is a petition that has been filed for grant of regular bail to the petitioner in FIR No.45 dated 24.04.2020 registered under Section 22 of the NDPS Act (Section 29 of the NDPS Act added later on) at Police Station Sadar Rampura, Bathinda who is in custody since 24.04.2020. Counsel for the petitioner inter alia contends that the petitioner has not been nominated in the said FIR and his name has been included only on the basis of a disclosure statement made by co-accused Balvir Kaur. The alleged recovery of 500 tablets of tramadol made from him is of noncommercial quantity. The trial is likely to take some time to conclude and therefore, prays for concession of bail to the petitioner. Learned counsel appearing on behalf of the respondent-State opposes grant of bail to the petitioner by contending that no ground for bail is made out.

Keeping in view the fact that the petitioner has been nominated in the said FIR on the disclosure statement of the co-accused and the alleged recovery effected from the petitioner is of non-commercial quantity coupled with the fact that the trial is likely to take some time to conclude, no useful purpose would be served by keeping the petitioner behind bars. The instant petition is allowed and the petitioner is directed to be released on regular bail on execution of adequate personal/surety bond to the satisfaction of concerned trial Court/Duty Magistrate. However, any observation made herein shall not be construed to be an expression on merits of the case.
