Petitioner has prayed for grant of emergency parole for a period of four weeks. Learned counsel for the petitioner inter alia contends that prayer of the petitioner for release on parole has been rejected by respondent no. 2. However, the order has been passed without considering the judgment reported as Gurpreet Singh vs. State of Punjab & anr. 2012(3) RCR (Crl.) 504.

In view of aforesaid contention, the matter is remitted to same authority for decision afresh after considering the judgment in Gurpreet Singh's case (supra).

Petition is allowed in these terms.
