The petitioner is seeking the concession of bail under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023 in case FIR No.123 dated 19.07.2024 under Sections 125, 333, 115(2), 191(3), 190 of the Bhartivya Nyaya Sanhita, 2023 and Sections 25 and 27 of the Arms Act, 1959, registered at Police Station Sadar, Ferozepur District Ferozepur. 2.
On 30.08.2024, while noticing the following submissions made by the learned counsel for the petitioner, this Court had granted the concession of interim bail to the petitioner and asked him to join investigation:- "Learned State counsel, on instructions, has not disputed that the only role attributed to the petitioner in the occurrence in question is of having thrown brick bats towards the house of the complainant. However, as per the allegations levelled in the FIR, when the accused party was fleeing away from the place of POONAM RATHORE 2025.01.08 11:29 I attest to the accuracy and authenticity of this document High Court Chandigarh

Learned counsel for the petitioner submits that in compliance of order dated 30.08.2024, the petitioner has joined investigation and cooperated with the investigating agency.

Learned State counsel, on instructions, does not dispute the factum of the petitioner having joined investigation and cooperated with the investigating agency. He, on further instructions, submits that the petitioner is not required for further investigation much less for his custodial interrogation.

In view of the above, the petition is allowed and interim order dated 30.08.2024, is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C./482(2) of BNSS, 2023.
