2 for grant of pre-arrest bail in FIR No.41 dated 29.03.2024 under Sections 304-B and 34 IPC registered at Police Station Sadar, Tarn Taran. 2.

As per the facts of the case, Surinder Singh brother of deceased victim gave his statement that his sister Karamjit Kaur got married about 1 1⁄2 years ago with Surinder Singh. They had given dowry articles as per their status. Manpreet Singh elder brother-inlaw/jeth was residing in Dubai and his wife Jagroop Kaur i.e. present petitioner is residing in village Khabo Dangra. Rupinder Kaur wife of Sukhdeep Singh sister-in-law of deceased victim along with other family members used to harass victim for bringing less dowry. There was demand of Rs.5 lakhs for sending Surinder Singh abroad. Victim




 came to know that her husband Surinder Singh was having illicit relations with his Bhabhi i.e. present petitioner. Complainant along with his family members tried to convince Surinder Singh regarding matter in controversy but they did not desist from these activities. On 29.03.2024 at 3 am somebody informed him telephonically that his sister died due to hanging on the previous night at about 7.30/8 pm and her dead body was lying in Civil Hospital, Tarn Taran. He along with his family reached hospital and saw the dead body. His sister committed suicide on account of demand of money raised by Rupinder Kaur as well as her husband Surinder Singh having illicit relations with present petitioner.

Learned counsel for petitioner argued that petitioner was granted interim bail by the Coordinate Bench vide order dated 31.08.2024 and in pursuance of this, she has already joined the investigation. Allegations levelled against petitioner are totally false and baseless. She is ready to join investigation as and when required. 4.

Status report is filed. It is pointed out that present petitioner is specifically named in the FIR with specific allegations. As per the post-mortem report of deceased - victim, there were seven injures on her body. Copy of post-mortem report is Annexure R-1. Report of Chemical Examiner Laboratory and Histopathology are yet to be recovered. Allegations are serious. Petitioner is yet to be arrested. However, Surinder Singh co-accused was arrested on 29.03.2024 and he is behind the bars. Investigation qua him was completed and challan is already presented and chargesheet is framed




 on 08.08.2024. Trial in that case is going on. 5.

I have considered the arguments and have gone through the record. Main allegations against present petitioner is that the deceased victim levelled allegations against her husband having illicit relations with the present petitioner i.e. his Bhabhi whose husband was residing in Dubai. It is claimed that due to the aforesaid factual position and other allegations levelled against co-accused Rupinder Kaur the deceased victim committed suicide and as per post-mortem report, there were injuries on her body. Present petitioner has already joined the investigation. She is not required for any other purpose nor any recovery is to be effected form her. Allegations detailed in the FIR are matter of trial. Main accused Surinder Singh is behind the bars and is facing trial.

Therefore, at this stage, without expressing my mind on the merits of the case, interim bail already granted by the Coordinate Bench on 31.08.2024 is confirmed subject to the conditions envisaged under Section 482 (2) BNSS.

Petition is, accordingly, disposed of.
