This order shall dispose off the above-captioned two appeals. The appeal being FAO-6014-2015 has been filed by the driver and owner of the Eicher Tractor-Trolley bearing registration No.HR-31D-7498 (hereinafter referred to as the 'offending vehicle') and the appeal being FAO-7422-2016 has been filed by the claimants aggrieved by the quantum of compensation JITENDER KUMAR 2026.01.22 09:45 I attest to the accuracy and integrity of this document Chandigarh
FAO-6014-2015 -2awarded by the Motor Accident Claims Tribunal, Jind (hereinafter referred to as 'Tribunal') on account of death of Randhir Singh (hereinafter referred to as the 'deceased') vide impugned award dated 01.05.2015. The parties are being referred to as the claimants and the driver and owner of the offending vehicle for the sake of clarity.

On 28.11.2019 the counsel appearing on behalf of the driver and owner of the offending vehicle in FAO-6014-2015 had stated that a compromise had since been effected between the parties and that the execution petition had been withdrawn. However, he sought time to place on record the order passed by the Executing Court. Thereafter, the matter was adjourned on numerous dates by order.

Today none has put in appearance on behalf of the driver and owner of the offending vehicle in FAO-6014-2015. As per e-Court website of District Courts Jind, vide order dated 06.10.2016 the matter was amicably compromised between the parties and it was stated that decree-holder had received entire decretal amount except ₹25,000/- lying in the High Court in the appeal filed by the judgment-debtors i.e. driver and owner of the offending vehicle (said amount of ₹25,000/- now stands remitted to the Tribunal). In view of the compromise, the execution petition was dismissed as withdrawn being fully satisfied. In view thereof, no ground is made out to entertain the present appeals.

Since none has put in appearance on behalf of the driver and owner of the offending vehicle in FAO-6014-2015, the same is dismissed for non-prosecution.

In view of the order dated 06.10.2016 passed by the Executing Court, the appeal being FAO-7422-2016 filed by the claimants is dismissed. 6.
