***** JASPAL SINGH, J Through instant petition preferred under Article 226/227 of the Constitution of India, petitioner has sought issuance of a writ in the nature of mandamus, directing the respondents to release the retirement-cum-service benefits, such as pension, gratuity, leave encashment, DA installments, arrears of revised pay scale and all other benefits along with interest. 2.

The contention of learned counsel for the petitioner is that the petitioner stood retired on 30.09.2017 as Inspector from Municipal Council on attaining the age of superannuation but till date no retiral benefits have been disbursed to her. Constrained from the inaction of the respondents, the petitioner served legal notice dated 17.01.2018 (Annexure P-3) through her counsel but it also did not fetch any reply. No action has also been taken for the disbursement of the retiral benefits, which were to be paid to the petitioner on her retirement Sonika 2018.03.09 16:28 I attest to the accuracy and authenticity of this document Chandigarh

CWP No.5672 OF 2018 --2-- or within some reasonable period. He further submits that there is/was no departmental inquiry or judicial proceeding pending against the petitioner on the date of her retirement.

Learned counsel for the petitioner submits that petitioner feels satisfied in case direction is issued to respondents to decide legal notice dated 17.01.2018 (Annexure P-3), within some prescribed period. 4.

Without expressing any opinion on the merits of the case, the instant petition is disposed of with the direction to respondents to look into the grievances unfolded by the petitioner in legal notice dated 17.01.2018 (Annexure P-3) and to decide the same, within a period of two months from the date of receipt of certified copy of this order. Respondents are further directed to calculate and make the interest @ 9% per annum on the delayed payments, after expiry of three months from the date of retirement till payment of various amounts.

However, if the petitioner still feels aggrieved against any of the order(s) passed by the concerned authority, she shall be at liberty to have recourse to the other remedies available to her as well as to approach this Court.
