This is the first petition under Section 483 BNSS read with Section 528 BNSS for grant of interim bail in case FIR No. 08 dated 10.2.2024, under Sections 21(C)/25/29/61/85 of NDPS Act, registered at Police Station Jhabal, District Tarn Taran.

In asking for the relief (supra), it is averred in the instant petition that the wife of the petitioner, is suffering from serious heart ailment, and requires immediate surgery, and apart from the petitioner, there is no other male member in the family, moreover, the petitioner has four minor children, who are also living with their ailing mother. 3.
This Court vide order dated 14.8.2024, directed the State to
file the status report, disclosing therein, the medical condition of the wife of the present petitioner. The reply dated 10.9.2024 has been filed by way of affidavit of Sh. Kamalmeet Singh, PPS, Deputy Superintendent of Police, Sub-Division Tarn Taran. The same is taken on record. 4.
As per the reply, the medical condition of the wife of the present petitioner namely Paramjit Kaur, was assessed through concerned Cardiologist, Civil Hospital, Tarn Taran on dated 26.8.2024, in which the following observation is made:- "the patient is suffering of Diabetes Mellitus III congestive Heart Failure with 30% Hypertension and the patient require immediate Admission for stunt and other Cardiac Treatment."

It is further mentioned in the reply that except the ailing wife of the petitioner, four children namely Kamaldeep Kaur, aged 20 years, Sukhmandeep Singh aged 17 years, Navdeep Kaur aged 15 years, Navraj Kaur aged 4 years, and brother of the present petitioner namely Kashmir Singh, who is bed ridden, and cannot walk were present at the house. Except the above persons, there is no other person available at the house, to take care of the wife of the present petitioner. 6.
In view of the specific status report, and considering the medical circumstances of the wife of the petitioner, and other mitigating circumstances, the instant petition is allowed. 7.
The petitioner is ordered to be released on interim bail for four weeks from the date of furnishing of requisite bail bonds and surety bonds
to the satisfaction of concerned Chief Judicial Magistrate/trial Court/Duty Magistrate.

In case the petitioner fails to re-surrender after four weeks, the SHO concerned shall take steps to arrest the petitioner and sent him back to prison.
